In October, the month-long trial in the ACT Supreme Court against her alleged rapist, Mr. Lerman, was aborted due to jury misconduct.

She alleged that Mr Lerman raped her on Parliament Hill after a night out in March 2019. He has pleaded not guilty and maintains his innocence.

The ACT’s Director of Public Prosecutions, Shane Drumgold, dropped the case altogether in December, citing concerns about Ms Higgins’ mental health.

Mr. Lerman sued Channel 10, Lisa Wilkinson and News Corp in federal court for publishing stories about Higgins’ allegations in February 2021.

The first day of the proceedings on Thursday did not go well for him, as he was questioned about drunken text messages he had sent to his then-girlfriend when Mrs. Higgins appeared in public.

Lerman’s girlfriend at the time, Greta Sinclair, was distraught at the unusual televised accusations.

He calms her down by sending letters implying that his lawyer told him he was a “pawn” and “part of a larger political job”.

During cross-examination in Sydney Federal Court on Thursday, Mr Lerman admitted to Teen lawyer Matthew Collins that Mr Korn never said that.

He reassured her, “If I’m named tonight, I’m in for millions in a libel case… (Mr. Korn) said I wouldn’t see the courtroom light.”

Later that evening, at 10.02pm, he sent Mrs. Sinclair another message saying: [Mr Korn] He continues to take notes though, very professional.

Under cross-examination in court, Lerman admitted that Korn had not in fact been taking notes during their conversation and insisted he only wanted to make Mrs. Sinclair feel good.

“I wanted her to think my house was okay.”

Dr. Collins suggested that the meeting with Mr. Korn “wasn’t at all professional” because “you were there pouring your heart out and drinking scotch” and “wasn’t Mr. Korn taking any notes?”

Mr. Lerman admitted: “It wasn’t. Not as I remember, no.
